These Terms & Conditions (“Terms”) govern your access to and use of the Auto Glass CRM operations platform, mobile field app, APIs and related services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent that you are authorized to bind that organization.
1.Accounts & eligibility
Access to the Service requires an account created or provisioned by your organization. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify your administrator promptly of any unauthorized use.
2.Acceptable use
You agree not to:
- Use the Service in violation of any applicable law or regulation.
- Attempt to gain unauthorized access to the Service, other accounts, or supporting systems.
- Interfere with or disrupt the integrity or performance of the Service.
- Reverse engineer or attempt to extract source code except as permitted by law.
- Upload content that is unlawful, infringing, or that you lack the right to provide.
3.Customer data & ownership
As between you and us, your organization retains all rights to the data you submit to the Service (“Customer Data”). You grant us a limited license to host, process and transmit Customer Data solely to provide and support the Service. You are responsible for the accuracy and legality of Customer Data and for having the necessary rights and consents, including for customer communications such as SMS.
4.Third-party services & integrations
The Service can connect to third-party providers (for example VIN decoding, glass-vendor pricing, mapping and routing, messaging, call analytics and payment processing). Your use of those integrations is subject to the applicable third party's terms, and we are not responsible for third-party services. Fees charged by third parties are your responsibility.
5.Payments
Where the Service facilitates payment links or processing, payments are handled by our third-party payment processor. You are responsible for the accuracy of amounts, applicable taxes and any chargebacks or disputes arising from your transactions.
6.Service availability
We strive to keep the Service available and reliable but do not guarantee uninterrupted or error-free operation. We may modify, suspend or discontinue features from time to time, and we may perform maintenance that temporarily limits availability.
7.Intellectual property
The Service, including its software, design, and content (excluding Customer Data), is owned by us or our licensors and is protected by intellectual-property laws. These Terms do not grant you any rights to our trademarks or branding.
8.Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement, to the maximum extent permitted by law.
9.Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill arising out of or related to your use of the Service.
10.Termination
Your organization or we may suspend or terminate access to the Service in accordance with the applicable service agreement or for breach of these Terms. Upon termination, your right to use the Service ceases; certain provisions that by their nature should survive will survive.
11.Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
